Settlement of $20 million from Playground Injury Settlement devastating brain injuries

A settlement of $20 million was reached in March 2009 in the a lawsuit against Burger King for the devastating brain injuries suffered by a 12 year old boy in a 2005 fall from a play structure inside a Burger King facility. The boy was playing with his 5 year old sister on the play equipment when he fell hitting his head on the tile floor. There was no protective matting below the structure to protect against such injuries. The play structure had monkey bars and a fireman's pole clearing presenting risks of children falling from the structure. 

The jury found that the restaurant should have provided some kind of protective covering on the floor rather than the hard tile on which the child fell. In addition, there were no warning signs around the equipment as present in other such facilities. Finally, there had been at least one other fall at the facility showing that the accident and injuries were foreseeable and preventable. The 12 year old boy suffered severe traumatic brain injury. The injuries are permanent. The child will require a life-time of medical and rehabilitative services. The jury obviously took these permanent injuries and future medical 
expenses into account in the enormous $20 million verdict.

School to pay $9.6m after boy sucked down drain

A COURT has sanctioned a $9.6 million compensation payout to a boy left brain-damaged after being sucked down a drain at an elite Anglican Gold Coast school. Myles Hill was a Year Seven boarder at The Southport School in February 2003 when he was sucked into an uncovered drain on the school grounds and swept about 400m down a pipe into a river.

He was submerged for about eight minutes and suffered a severe brain injury which means he now requires 24-hour care. His family last year launched legal action in the Supreme Court in Brisbane against the Corporation of the Synod of the Diocese of Brisbane, seeking damages to help pay for Myles's care. Late last month the parties reached a compromise - which was sanctioned on Tuesday in the Supreme Court in Brisbane - on the amount Myles will receive. According to the court order, the Anglican Church has agreed to pay Myles and his family $9.63 million.

Pfizer $2.3 billion settlement is the largest healthcare fraud settlement

Parker Waichman Alonso LLP represented a whistleblower in one of the lawsuits
involved in the recent $2.3 billion Pfizer settlement. The whistleblower lawsuit
alleged that Pfizer illegally promoted the off-label use of the antipsychotic
medication Geodon.

The Parker Waichman Alonso lawsuit was one of nine settled by the U.S.
Department of Justice that charged Pfizer illegally marketed Geodon, as well as
the pain killer Bextra; Zyvox, an antibiotic; and Lyrica, an anti-epileptic
drug. The civil settlement also resolves allegations that Pfizer paid kickbacks
to health care providers to induce them to prescribe these, as well as other,
drugs.

Under the terms of the settlement, Pfizer subsidiary Pharmacia & Upjohn Company
Inc. has also agreed to plead guilty to a felony violation that it illegally
promoted the off-label use of Bextra. Pharmacia & Upjohn will pay $1.3 billion
toward the total settlement.

The $2.3 billion settlement is the largest healthcare fraud settlement in the
history of the U.S. Department of Justice. The Geodon portion of the settlement
was $301 million.

$700,000 Settlement Reached with the Family of an Ice Cream Truck Driver

The Henderson City Council has signed off on a $700,000 settlement with the family of an ice cream truck driver who was shot and killed by police in front of her husband and two children.

The city admits no liability or wrongdoing in the death of Deshira Selimaj, but the settlement ends a federal lawsuit that sought $25 million in damages.

Council members approved the $700,000 payment on Tuesday night along with about 45 other consent agenda items that were adopted in a single unanimous vote. The money will come from the city's self-funded liability reserve.

Last lawsuit settled against Norwich police lieutenant

Norwich — The city has tentatively settled a lawsuit with a young woman who charged that a former Norwich police lieutenant took topless photos of her in 2001 under the guise of using them for police business.

Kristen Ejchorszt was the first person to raise the allegations against Lt. James Daigle. In the ensuing months, two other women came forward with similar allegations, and further charged that Daigle took fully nude pictures of them. Ejchorszt said that Daigle recruited her to participate in an underage-drinking sting on Nov. 30, 2001. Daigle told her the topless photographs were necessary to properly document the sting, she claims.

City Corporation Counsel Michael Driscoll said this morning he learned of the settlement Wednesday just as jury selection was set to get underway in U.S. District Court in Hartford. Driscoll said the Connecticut Guaranty Insurance Fund would pay the $75,000 settlement since the city's insurance carrier at the time has gone into receivership.

Two Massachusetts Students Get $18.9 Million Personal Injury Settlement For Burn Accident Caused By Chemistry Experiment

Calais Weber and Cecilia Chen, both 17, are now college students studying in Massachusetts. Calais is a Wellesley College undergraduate, while Chen studies at Harvard. The two students are also burn injury survivors of a chemistry experiment gone bad when they were high school students at Western Reserve Academy, a private boarding school in Ohio.

This month, the two students and their families settled their personal injury lawsuit with the school for $18.9 million. Weber and her family received $13.1 million, and Chen and her family received $5.8 million.

46% of Weber’s body sustained burn injuries. She became very depressed after the accident and considered committing suicide. She has had at least 16 surgeries to treat her injuries so far and says she was unrecognizable to herself after the accident.
